Request for Extension of Time for Records Retention Related to the 11/3/2020 General

Please use the following email addresses to prepare and send emails TODAY to the county clerk’s office, the county DA’s office and at max 2 of the county commissioners (I chose Chairman Sanchez and my own Commissioner Shannon Reynolds for my district) to request an extension of time to review documents beyond the 22 months pursuant to the provisions of 1-12-69.C of the NM Elections Code.

According to the following provision in the New Mexico Election Code,   ”1-12-69. Disposition of paper ballots.   A. Paper ballots marked by voters and all records related to voting in any election in which a federal candidate appears on the ballot shall be retained and preserved for  a period of twenty-two months from the date of the election.”
With Reference to the Dona Ana County Clerk’s office and on-going review of election records which have been an on-going audit conducted via IPRA requests, and in as much as the use of the voting system machines have been in controversy, the above provision of the NM State Election Code allows a minimum of 22 months for the review and analysis of such documents.  I believe it is necessary for an effort to be made to restore the confidence in our voting system that you have the power to impact.  I respectfully request that you, in your capacity as a county official, please extend the time for inspection of all election ballots and records while a review of the records is in the process of being completed pursuant to 1.12.69C as follows:
      ”1.12.69.C.  In precincts where a recount or judicial inquiry or inspection of contents is sought, the county clerk shall hold ballots marked by voters and records related to voting in those precincts intact until forty-five days following the recount, judicial inquiry or inspection of contents is completed, whichever is later.”
